By using the COPD-PS Tool, User (“User”) understands and agrees that: (1) User may make hard copies and use the paper version of the COPD-PS Tool with patients in his or her practice at no cost to User; (2) User may electronically store a PDF version of the COPD-PS tool and print such version for use with patients as part of their practice at no cost to User; (3) when completed by patients as part of the User’s practice, the User may scan and store copies of the completed COPD-PS tools in their paper or electronic medical record at no cost to the User. To ensure that evaluator validation is maintained, User shall not and shall not cause any third party to modify or amend the COPD-PS tool in any way without the prior written consent of OptumInsight Life Sciences, Inc. (f/k/a “QualityMetric Incorporated”) (“QM”). The user understands and agrees that any modification or amendment may affect the validation of the COPD-PS and QM will not be responsible for the results of the COPD-PS or any validation thereof pursuant to a modified or amended COPD-PS.
Inclusion in Electronic Health History Systems:
Physicians, group practices, and other Authorized Users, as applicable, may incorporate the COPD-PS tool into their own electronic medical record systems for use solely with patients in their own office at no cost to such User as permitted in (2) of the preceding paragraph or otherwise incorporate the COPD-PS tool into the User’s electronic medical records system provided that it is for exclusive use with patients within the User’s own office. To determine whether any other electronic use is permitted and to ensure that rater validation is maintained, User is encouraged to contact QM prior to incorporating the COPD-PS tool into User’s electronic medical records system, except as permitted in (2) above or by scanning full copies of the tool. User shall not and shall not cause others to include the COPD-PS Tool in an electronic medical record system for commercial benefit (i.e., shall not authorize or permit any third party to market, lease or sell any electronic version or any electronic medical record system containing the COPD-PS Tool) without the written consent of QM.
